Kenya to Update Certificate of Origin Requirements

21 Jul 2025 | Alex Sonifrank

The American World Trade Chamber of Commerce (AWTCC) has gotten multiple reports from exporters seeking to do business in Kenya that they are facing new requirements. The Kenya Revenue Authority issued new regulation which impacts current US shipments destined for Kenya. The notice outlines a short grace period, suggesting US exporters shipping to Kenya need to quickly ensure their process is aligned with the new rules. The notice outlines clearly the amendment regarding the certificate of origin, stating: “mandatory for all consignments imported into Kenya to be accompanied by a Certificate of Origin (COO) issued by a competent authority from the country of export.” The full text of the notice is available below.

The Specifics

The notice details information required for the certificate of origin. This information is aligned with the International Chamber of Commerce guidelines and aligned with the requirements set by AWTCC. Chamber stamps on certificates of origin are available to companies registering with AWTCC which would ensure compliance with the new requirement.

Further, exporters have reported receiving samples of certificates of origin that qualify under the ICC CO accreditation chain. AWTCC meets this standard and as such certificates of origin issued by AWTCC will be in line with expectations of customs in Kenya.

The notice also details that penalties will be issued for failure to comply, which can include fines and seizure of goods.

Action Required

Companies already working with AWTCC will be able to continue to request certificates of origin as usual. Companies not already registered with AWTCC will be required to register for an account first.

The American World Trade Chamber of Commerce (AWTCC) in effort to expand opportunities for education has partnered with Trade Technologies around their upcoming letter of credit training. AWTCC has established a discount for members which will discount the training course to $65. The event will be Wednesday, August 20th at 01:00pm EDT and will focus on documentation in the letter of credit process. Letters of credit are likely to get more common in the near future as exporters are looking to new destinations and new opportunities. In these situations, letters of credit can offer more safety for the buyer and seller both but also come with more work. Trade Technologies has focused on navigating this process and the training course provided will help US exporters learn how best to navigate and handle letter of credit requirements.

Today though, US companies are more and more often needing to demonstrate how they qualify for USMCA. Companies are being often caught by surprise, needing to demonstrate how their product qualifies as US origin under the terms of the USMCA agreement.
